Dorothy Fowler brought suit alleging that her fathers will, which had been probated in common form, was the product of undue influence and made without testamentary capacity. The cause was tried before a jury in the Chancery Court of Lauderdale County. At the close of contestants case, the trial court sustained a motion to exclude the evidence and directed a verdict for the proponents of the will. The contestant appeals contending the trial court erred in denying a jury trial in a will contest, in granting a directed verdict and in suppressing evidence in limine. The issues are:
