Action in the district court for Carver county by the special administratrix of the estate of William G. Beckman to recover for his death, resulting from injuries sustained in a collision between the car of defendant Marcus Hertsgaarde, in which decedent was riding, and one owned and operated by defendant Martin C. Schroeder. The case was tried before Martin A. Nelson, judge of the tenth judicial district acting for the judge of the eighth judicial district, and a jury, and a verdict of $10,000 returned for plaintiff against defendant Schroeder and in favor of defendant Hertsgaarde. From an order denying his motion for a new trial, defendant Schroeder appealed.
